ROADWAYS ORDINANCE

10.01 Road Approaches

To meet the various needs of the property owners desiring access to town, county and state roads, the general design requirements for these road approaches are described as follows:

Road approaches are those approaches necessary to permit normal travel from a residence or farm for their normal use, or some other special, noncommercial purpose approved by the town or county engineer.

(1) The location of road approaches must be consistent with the regulations in these rules and must not infringe on the frontage of adjoining property. Each road approach must be located so that it does not cause undue interference or hazard to the free movement of road traffic, as determined by the town or county engineer;

(2) Any person wishing to construct a road approach shall file an application with the Town Clerk and shall pay a $20.00 processing fee. Final approval of said location of the road approach shall be determined by the Town Engineer and/or Town Chairman.

(3) Surface drainage must be provided by the land owner unless otherwise stated. The drainage under fill areas and in roadway ditches must be large enough to carry the water that accumulates in the roadway ditches and in no case shall the size of the pipe be no smaller than fifteen inches in diameter culvert pipe and twenty-six feet in length;

(4) The length of approach pipe placed in roadway ditches shall be limited to one hundred feet unless cleanouts are provided for at distances not to exceed one hundred feet. Cleanouts shall consist of manhole type structures which will meet existing conditions, as approved by the town or county engineer.

(5) All permanent structures shall be located at least ten (10) feet from all lot lines abutting right-of-ways so that a clear field of view is maintained.. [Amended 7/6/04]

10.02 Drainage provisions.

The land owner for said road approach must make provisions for handling the drainage from his own property, and no drainage that is caused by these installations of road approaches shall flow from commercial or private property onto the surface of the town, county or state road.

10.03 Construction of approaches.

Construction requirements for all road approaches shall be as follows:

(1) All construction requirements of the land owner must be completed within a reasonable time and in a manner that is satisfactory to the town or county engineer;

(2) Approaches and related area must be constructed so that they do not impair drainage within the right-of-way, nor alter the stability of the roadway subgrade, nor materially alter the drainage of adjoining lands. Culverts, catch basins, ditches, etc. are to be constructed and maintained in accordance with the specifications and standards of the town or county engineer;

(3) Roadway approaches may not exceed a grade of twelve (12) inch upward grade on all approaching driveways for a distance of the first 50 feet, and a four (4) foot upward grade for the next 100 feet, measured from the start point of the intersecting points of the roadway.

(4) The town or county engineer has the right to specify the type, depth and area for surfacing and pavement for all road approaches;

(5) All material needed to construct road approaches must be supplied by the land owner. Materials must be satisfactory quality and in general conform to town or county road department specifications for that type of work. Construction materials are subject to approval by the town or county engineer.

10.04 Penalties.

Any person who shall violate any of the provisions of this ordinance shall be subject to a forfeiture of Two Hundred Dollars ($200.00) and shall be required to comply with the ordinance within a reasonable time. If after a reasonable time, the party fails to abide by the provisions of this ordinance, the Town may perform the work necessary to make the road approach comply with the ordinance and assess the land owner the costs of said work on the land owners’ next tax roll statement.
